Annex 2 of the revised Waste Framework Directive has been amended and the formula for calculating energy efficiency, commonly known as R1 will change from 31 July 2016.

Consultation description

Annex 2 of the revised Waste Framework Directive (2008/98/EC) sets out a non-exhaustive list of recovery operations. Operations that use waste principally as a fuel to generate energy are classed as R1 under the list. Energy from waste plants dedicated to the processing of municipal solid waste that is classified as recovery must meet a specific energy efficiency threshold included in the R1 formula.

The consultation outlines these changes in detail and seeks views on these changes.

We have identified 2 Acts of Parliament and a number of statutory instruments which contain references to ‘recovery’ and ‘Waste Directive’.

We propose to update the references to ‘Waste Directive’ and ‘recovery’ to ensure the references relate to the Waste Directive as updated by the EU Directive 2015/1127.

We are asking the industry if they have any concerns about the way we intend to make these changes and we are keen to hear from:

  • local authorities
  • Natural Resources Wales
  • landfill operators
  • energy from waste operators
  • operators of permitted and exempt waste facilities
  • professional and membership organisations
  • businesses/private sector
